1. Overview

Landmarq, Inc. ("Landmarq," "we," "us," or "our") is a Florida corporation committed to protecting your privacy. This Privacy Policy explains what information we collect, how we use it, and your rights in relation to it. By accessing or using Landmarq, you acknowledge that you have read and agree to this Privacy Policy.

2. Information We Collect

We collect the following categories of information:

  • Account information: Your name, email address, and state when you join our waitlist or create an account.
  • Property data: Address, purchase price, square footage, year built, and other property details you enter into the platform.
  • Usage data: Pages visited, features used, and interaction events — collected to improve the product experience.
  • Device and log data: IP address, browser type, operating system, and timestamps from server logs.
  • Payment data: Billing information processed by our payment provider. We do not store full payment card details on our servers.

3. How We Use Your Information

  • To provide, operate, and improve the Landmarq platform.
  • To generate property valuations and portfolio analytics.
  • To send you service-related emails such as waitlist updates, launch notifications, and alerts you configure.
  • To process billing and manage your subscription.
  • To respond to support inquiries.
  • To detect fraud, abuse, or security incidents.
  • To comply with applicable legal obligations.

4. We Do Not Sell Your Data

Landmarq does not sell, rent, lease, or otherwise share your personal information or property data with third-party brokers, real estate agents, data aggregators, or advertisers — ever. Your property data is yours. We make money through subscriptions, not by monetizing your information. This commitment applies regardless of whether you are a California resident or located in any other jurisdiction.

5. Data Sharing

We share data only in the following limited circumstances:

  • Service providers: We use vetted third-party vendors (hosting, payment processing, email delivery, analytics) who process data on our behalf under strict confidentiality agreements and are prohibited from using your data for their own purposes.
  • Agents you invite: When you invite a listing agent to your property's Realtor Portal, they can view activity data for that specific property only. You control this access and can revoke it at any time, instantly.
  • Legal obligations: We may disclose information if required by applicable law, valid legal process (including a subpoena or court order), or to protect the rights, property, or safety of Landmarq, its users, or the public.
  • Business transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred to a successor entity, subject to the same privacy commitments outlined in this policy.

6. Data Security

We use industry-standard encryption (TLS in transit, AES-256 at rest) and access controls to protect your data. Access to personal data is restricted to employees and contractors who require it to operate the Service. No system is 100% secure, but we take commercially reasonable precautions to protect your information from unauthorized access, disclosure, alteration, or destruction. In the event of a data breach that affects your rights or freedoms, we will notify affected users as required by applicable law.

7. Data Retention

We retain your personal data for as long as your account is active or as reasonably necessary to provide services, comply with legal obligations, resolve disputes, and enforce agreements. If you delete your account, we will delete or anonymize your personal information within 30 days, except where retention is required by law or legitimate business purposes (e.g., fraud prevention, tax records).

8. Your Rights

Depending on your jurisdiction, you may have the following rights regarding your personal information:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Request correction of inaccurate or incomplete data.
  • Deletion: Request deletion of your account and associated personal data, subject to legal retention requirements.
  • Opt-out: Opt out of non-essential communications at any time via the unsubscribe link in any email we send.
  • Portability: Receive your data in a structured, machine-readable format.
  • Restriction: Request that we restrict processing of your data under certain circumstances.

To exercise any of these rights, contact us at hello@landmarq.app. We will respond within 30 days. We will not discriminate against you for exercising your privacy rights.

9. California Residents — CCPA/CPRA

If you are a California resident, the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) grant you specific rights, including:

  • The right to know what personal information we collect, use, share, or sell (we do not sell your data).
  • The right to delete personal information we have collected from you, subject to certain exceptions.
  • The right to opt out of the sale or sharing of personal information. As stated in Section 4, we do not sell or share your personal information for cross-context behavioral advertising.

11. Children's Privacy

Landmarq is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If we learn that we have collected personal information from a person under 18, we will promptly delete it. 12. Third-Party Links

The Service may contain links to third-party websites or services. We are not responsible for the privacy practices or content of those third parties. We encourage you to review the privacy policies of any third-party sites you visit.
